Omega Case Co., Inc. (“Manufacturer”) warrants that its products are free from defects in workmanship and materials for the lifetime of the warranted product and only to the original purchaser. Manufacturer’s liability under this warranty is limited strictly to the repair or replacement, at its sole discretion, of defects attributable solely to defective construction, workmanship, or materials.
No other express or implied warranties are provided. Any implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose, are expressly excluded to the fullest extent permitted by law.
What Is Not Covered
This warranty does not apply to damage arising from:
Normal wear and tear
Misuse, negligence, accident, or improper handling
Improper loading, unloading, transport, shipping, or storage
Modifications, alterations, or tampering with the product
Environmental conditions beyond Manufacturer’s control
Once a product leaves Manufacturer’s facility—whether picked up by the purchaser, their agent, or transported by a carrier—any damage to the case, hardware, components, contents, or related equipment becomes the sole responsibility of the purchaser. Manufacturer is not responsible for any damage occurring after the product departs its facility.
Limitation of Liability
Manufacturer shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:
Damage to equipment or property
Loss of use
Lost revenue or business interruption
Personal injury
This limitation applies even if the Manufacturer has been advised of the possibility of such damages.
Warranty Service
For approved warranty repairs, the purchaser is responsible for:
All shipping costs
Packaging and insurance
Transportation to and from Manufacturer’s facility
Manufacturer covers only labor and materials related to the warranted repair.
Additional Terms
If any provision of this warranty is deemed unenforceable, the remaining provisions remain in full force and effect. No modification of this warranty is valid unless it is made in writing and signed by the Manufacturer.
